Questions
What people ask before they send us the letter
Short answers, written in general terms. The rules that apply to you depend on your documents and on state law.
For homeowners
Can I ask the board to reconsider a fine?
Often yes. Many documents give a hearing or a written appeal, and the letter should say how to ask. We read the documents, write the request and keep the deadline on the calendar.
A neighbor broke the same rule and nothing happened. Does that help?
It can. Enforcement that falls on one owner and not on others is worth raising, in writing and with dates. It does not settle the matter, and your documents may say how the board decides which rules to enforce.
Can I see the association's records?
Usually, within limits your documents and state law set. We send the request in writing, note the date and follow up if the reply is late.
For boards
Does the board need a lawyer at every meeting?
No. Most boards need an answer between meetings and a lawyer at the table for a few hard agenda items a year. We answer questions between meetings and sit in on the hard items.
Can you review our documents before we amend them?
Yes, and we would rather. A document audit shows what an amendment would need, including the vote your documents require, before the board asks owners to sign anything.
How do we avoid enforcing rules unevenly?
Write the steps down and apply them in the same order to every account or violation. A short policy adopted at an open meeting does most of the work, and we can draft it.
Fees
Do you charge by the hour?
Mostly flat fees for letters, plans and documents, and a quoted fee for board advice. Where a matter has to be hourly, such as a court case, we say so and give a rate before we start.
Which side do you represent?
One side per community. Matilda and Hiram act for associations, and Verity acts for homeowners in communities where the firm does not advise the association. We check before every first conversation.
Still not sure which of us you need?
Tell us which side of the table you sit on. We will say which lawyer, and what the first step costs.
